الطعن رقم 2741 لسنة 61 بتاريخ :1998/05/27
الإزعاج وفقاً لنص المادة 166 مكرراً من قانون العقوبات لا يقتصر على السب والقذف لأن المشرع قد عالجهما بالمادة 308 مكرراً . بل يتسع لكل قول أو فعل تعمده الجاني يضيق به صدر المواطن . وكان الحكم المطعون فيه لم يبين ما أسمعه الطاعن ، شخص المجني عليه من قول أو قارفه من فعل ، بطريق التليفون ، تعمد فيه أولهما إزعاج ثانيهما ، باعتبار أن هذه الجريمة من الجرائم العمدية ، كما لم يبين الحكم كيف اعتبر أن الطاعن – وقد حادث المتهمة الأولى ، حديثاً رضائياً بينهما ، عبر التليفون ، قد تعمد إزعاج المجني عليه ، وجاء الحكم – إضافة إلى ما تقدم – خلواً مما يكشف عن وجه استشهاد المحكمة بالأدلة التي استنبطت منها عقيدتها في الدعوى ، ومدى تأييدها للواقعة ، ومدى تأييدها للواقعة ، كما اقتنعت بها المحكمة . وبما تتوافر به عناصر الجريمة ، فإنه يكون مشوباً بالقصور الذى يعجز محكمة النقض عن مراقبة صحة تطبيق القانون على الواقعة كما صار إثباتها بالحكم ومن ثم يتعين نقضه والإعادة بغير حاجة إلى بحث باقي أوجه الطعن ، مع إلزام المطعون ضده بالمصاريف المدنية ولما كان هذا المنعى يتصل بالمحكوم عليهما … و …….. وكانا طرفاً في الخصومة الاستئنافية ، التي صدر فيها ذلك الحكم . فإنه يتعين نقض الحكم بالنسبة إليهما كذلك . ولو لم يقررا بالنقض وذلك عملا بالمادة 42 من القرار بقانون رقم 57 لسنة 1959 في شأن حالات وإجراءات الطعن أمام محكمة النقض .
